    Instructing Internet Erasure:

    I authorise and appoint Internet Erasure Ltd, Company Registration Number 13916445, of Suite 5, 5th Floor City Reach, 5 Greenwich View Place, London E14 9NN. (henceforth IE), as agent, to:

    1.    Perform detailed research to locate damaging content which appears when my name is searched online, or which identifies me, or which contains content relating to my case, and to present this information to me, in the form of an Adverse Media Report.

    2.    Draft and submit 'Right to be Forgotten' applications under GDPR Article 17, requesting delisting from the four primary search engines, (Google, Bing, Yahoo and DuckDuckGo), to argue and advocate for me as required, and to deal with all related communications on my behalf.

    3.    Request evidence relating to my case, either from me, or from third parties with my further authority, if required to strengthen my legal grounds for removal from search engine results pages.

    4.    Draft and submit follow-up complaints to the Information Commissioner (ICO), Scottish Information Commissioner, Irish Data Protection Commission, or other relevant Data Protection Authority, if required, and to deal with all related communications on my behalf.

    5.    Make direct approaches to publishers, domain registrars, webhosting companies, content management systems, software providers and other platforms, to request deletion, anonymisation, the addition of 'NoIndex' tags or for corrections to be made, if considered appropriate by IE and at IE's sole discretion, and to deal with all related communications on my behalf.

    6.    Draft and submit follow-up complaints to The Independent Press Standards Organisation (IPSO), or other applicable regulator, if considered appropriate by IE and at IE's sole discretion, and to deal with all related communications on my behalf.

    7.    Perform any additional work identified to remove (deindex) articles, images, videos and other content links which are having a detrimental effect on my life, from search engine results pages in the UK and EU, and under the terms of this service agreement, and to deal with all related communications on my behalf.

    Data Protection:

    I consent to IE:

    1.    Processing and storing my personal information and sensitive personal data regarding past events, convictions and related or relevant matters.

    2.    Sharing my personal information under confidential header, or GDPR privacy frameworks, solely for the purpose of achieving the deindexation of search engine links and the removal of articles, images, videos, or other unwanted content, from the internet.

    Fees:

    I have been accepted as a client under a fixed fee scheme. No other fees will be due or payable unless additional work is requested by me and agreed in writing in advance. I agree that fees due to IE are payable in full on instruction. I understand that any monthly instalment arrangement is at the sole discretion of IE. If I have agreed to an instalment arrangement, I have satisfied myself that it is sustainable. I understand that if I do not make payments as they fall due, then the entire sum shall immediately become due and payable and that it is at the sole discretion of IE whether they then continue working on my case.

    Confirmations:

    If applicable, I will follow the legal requirements for disclosure of unspent criminal convictions, both before, and after, any successful removal of search engine links.

    I have been made aware from the free guide to the Right to be Forgotten generously provided on this website by IE that I personally have the rights to apply to the search engines, complain to The Information Commissioner, contact publishers, webhosts and other stakeholders and complain to the Independent Press Standards Organisation, and that if I choose to do this, I will incur no costs, however that by signing this agreement I am making an informed choice to pay experienced professionals to investigate and perform all the work required on my behalf.

    I agree that I will protect IE's proprietary information and trade secrets. I shall not disclose any of IE's documents, processes, legal arguments or other potentially commercially sensitive Intellectual Property (IP) to any third parties without the prior permission of IE. Without prejudicing my right to access my personal data I irrevocably give my permission for IE to redact or decline to provide anything to me or to my representatives, which IE reasonably considers to contain their IP, at their sole discretion. I further agree that I shall not leave any review on any platform until and unless IE confirm that they have finished working on my case.

    I understand that the timeline for removal on damaging online content depends on numerous varying factors which are outside of IE's control, but that IE will use their BEST ENDEAVOURS and will continue to act for me until all of the adverse media identified at the point of instruction and relating to the subjects quoted, has been blocked from appearing in search results under my name, in the UK and EU and that they will keep me informed throughout the process.

    I shall not hold IE in any way responsible at any time for the presence, accessibility or consequences of the adverse media appearing online. I shall at all time treat IE reasonably and not apply unreasonable pressure to IE caseworkers whilst they are working diligently on my case.

    Duration:

    This contract continues for the latter of either:

    1.    12 months from instruction.

    2.    3 months after the full removal from search engine results pages, of all those URL’s identified in the initial Adverse Media Report (this is provided to client within 10 days of instruction), no matter how much time this has taken to achieve.

    After this time, proactive checking of search results by IE on behalf of the client will cease.

    If at any time, after this contract has expired, the client makes IE aware of URL's that have appeared in search results under their name, which pre-date this service agreement and which relate to the same subject, IE will make no further charges for removal submissions to the search engines.

    The removal of URL's published after this service agreement has been signed or which relate to a different subject from that originally quoted are outside of the scope of this service agreement.

    Cooling off:

    I am free to cancel this agreement at any time within 14 days of signing, by sending an email to [email protected]. I confirm however that I would like the service to begin immediately, and not after the 14-day cancellation period.

Communications:

Emails sent to casework(at)interneterasure(dot)co(dot)uk are typically replied to within 30 - 180 minutes during weekdays from 8am - 5:30pm. Emails sent outside of these hours are considered to have been received the following morning. We often double-send important emails to ensure safe receipt, particularly emails containing lots of weblinks or large files which are more likely to be undelivered. If you have sent us an email but have not received a reply within 24hrs, please check your junk / spam folder and contact us by another method.

Emails marked OFFICIAL or OFFICIAL-SENSITIVE (typically from police, probation, CPS or other approved organisations operating in the Criminal Justice Sector), must be sent by Criminal Justice Secure Mail (CJSM) to our Senior Caseworker whose CJSM is available upon request.

WhatsApp messages to 07565 130 116 are typically replied to within 5 - 60 minutes during weekdays 8am - 8pm. WhatsApp messages sent outside of these hours are considered to have been received the following morning.

Telephone calls to 020 3576 0356 (UK), +44 20 3576 0356 (International), made on weekdays between 8am - 8pm, are personally answered by our receptionists who will note caller details and a brief subject overview. A mutually convenient time for a full telephone call with the most suitable caseworker (e.g. criminal justice, professional misconduct, harassment, MHFA accredited, technical support, general GDPR, or an existing assigned personal caseworker) is then arranged by WhatsApp or email.

Communications in the Evening, Weekend and at Bank Holidays are responded to the next working morning.

Due to our criminal justice and harassment work, we do not accept telephone calls from withheld numbers or from people who are currently service a prison sentence. As a family firm we do not generally offer an emergency service, engage in highly pressurised circumstances, or accept urgent or short-term cases. Telephone calls and conferences are usually booked in advance and workflow is scheduled. Work does however start on all new cases within 48hrs of instruction. If you are not yet a client of our firm, we may ask to see proof of identity at any time, and may stop engaging with you by any method if we have any doubts as to your identity, or your authority to act on behalf of a third-party, or for any other reason at our sole discretion.

Communications and data which may include sensitive personal data in the form of client notes, evidence and communications, is processed, retained and deleted in accordance with our Privacy Policy.

Payments:

Quoted fees are payable in full on instruction.

The payment process forms part of our ID verification, anti-fraud and anti money laundering checks.

We accept online payments by all types of credit and debit cards, however we do not accept card payments over the telephone.

We welcome card payments in any currency and these are processed by our payment processor which is PayPal.

We accept UK bank transfers, with our client's full name as reference, to Internet Erasure Ltd, Sort Code 60 83 71, Account Number 53292077.

In a minority of cases, we may offer monthly payment terms, in the form of an installment credit agreement which meets the criteria for exemption from FCA regulation because a) no interest or additional sums are charged, b) it is repayable by no more than 12 installments within no more than 12 months, and c) it finances a specific service for a fixed amount. Credit searches will not be carried out and a client must satisfy themselves that they are certain that any monthly installment arrangement is sustainable for the entire duration of the arrangement. Work on a client's case may stop if fees are not paid in accordance with any monthly payment arrangement made. The offering of any payment terms is on a case-by-case basis and is at our sole discretion. 

In a minority of large cases, we may offer to work on a hybrid success-fee basis, typically where there are many hundreds of URL's requiring removal across multiple subject areas. In these cases a large initial fee will typically be charged and this is to be followed by a success fee when pre-agreed benchmark achievements are met. Work on a client's case may stop if fees are not paid in accordance with any success-fee arrangement made. The offering of any hybrid success-fee terms is on a case-by-case basis and is at our sole discretion. 

In a minority of cases, we may offer a Conditional Fee Agreement (CFA), also known as no-win no-fee. These are only available for work which we consider to be experimental (and for which we are unable to give a guaranteed outcome), or when undertaking work for which we are seeking to either improve our processes, or to grow our in-house precedents; such terms are rare and are offered based on workflow limits and at our sole discretion. 

In a minority of cases, we may offer to work Pro-bono (undertaken voluntarily and without payment). This is only offered by our firm based on workflow limits, and in a small number of cases which we consider meet an exceptionally high threshold of evidenced injustice and extreme hardship; pro-bono terms are offered at our sole discretion.

Legal Aid, or Public Funding, is not available for the work we perform. 

We accept payment directly from insurance companies and any regulated legal or accountancy firms on behalf of clients, where the scope of work is approved and fees are agreed in advance in advance of formal instruction.

Internet Erasure do not accept untraceable payments; for clarity this means that we do not accept cash and you cannot pay us with assets of any description or with cryptocurrencies of any kind.

Internet Erasure Ltd are a team consisting of media and data protection lawyers, privacy experts, criminal justice caseworkers, researchers and PR / reputation management specialists providing legal, technical, and administrative assistance to clients, as well as formal representation on their behalf.

We correctly use the words 'advocacy' and 'to advocate for' in the context of, and meaning, advancing arguments on behalf of our clients, supporting them, representing them and speaking on their behalf; we do not suggest, imply or state that we have rights of audience (authority to appear and conduct proceedings in court on behalf of clients), that we are high court advocates or that we are members of the Faculty of Advocates.

Internet Erasure Ltd provide between 2 - 3 hours of free Continuing Professional Development (CPD) contributions towards The SRA's Continuing Competence Requirements to non-competing solicitors in England and Wales, who may also have an interest in introducing clients to our firm. The CPD offered consists of insights into the legislative framework around the Right to Erasure, a broad overview of our cases, and the practical applications of GDPR Article 17 and the Right to be Forgotten as they apply to removing damaging or unwanted online content from search engines and other platforms with particular relevance to firms working in the Criminal Justice Sector. The offer and delivery of CPD to any firm is based on workflow limits and is at our sole discretion. 

We also routinely accept direct engagement from barristers, solicitors and paralegals and otherwise regulated firms on behalf of clients.
